Резюме
The Constitution of the Republic of Bulgaria and its 2023 amendments regulate the Supreme Judicial Council and maintain its division into two colleges. A definitive answer is not yet been reached to the question whether the Prosecutorial college can appoint an incunbent Prosecutor General, given that the Plenary of the Council elected the current office-holder, prior to the amendments. If the Plenary holds this competence, then any decision taken by the Prosecutorial College would fall within the most serious defects of administrative law – lack of competence, which leads to nullity.
