CURRENT PROBLEMS OF LEGAL PROTECTION OF INTELLECTUAL PROPERTY. PART II. REGARDING THE NUMBER OF ADMINISTRATIVE VIOLATIONS IN THE PUBLIC PERFORMANCE OF A RECORDING OF A MUSICAL WORK IN VIOLATION OF THE COPYRIGHT AND RELATED RIGHTS ACT

Abstract

The article examines issues related to administrative liability in the event of a violation of the right to public performance of recordings of musical works and, more specifically, whether the performance of an individual recording constitutes a separate violation, or whether the violation is one, regardless of the number of publicly performed recordings in violation of the Copyright and Related Rights Act. Due to the setup of contradictory court practices, the above question became the subject of interpretative case No. 4/2022 of the Supreme Court of Appeal. This article was prepared based on an opinion presented in the interpretative case, which substantiates the understanding of only one, and not separate, violations.
