Валутното престъпление като пример за косвеното влияние на правото на ЕС върху националното наказателно законодателство

The currency crime as an example of the indirect impact of EU law on national criminal law

Abstract

Art. 83 of TFEU directly influences the provisions of the Bulgarian Criminal Code. There is also an indirect path for the influence of EU legislation
on national Criminal Law. This indirect influence is exemplified by the analysis of the amendments of art. 251 of Bulgarian Criminal Code for the past 30 years. On this basis, both paths of reception of EU Law into national statutory law are assessed as necessary and mutually beneficial.

Keywords

harmonization of national laws, criminal law, influence of EU Law
