The Principle of Good Faith in the Austrian and Bulgarian Legal Systems

Abstract

The paper presents some features of the interpretation of good faith principle in the legal systems of Austria and Bulgaria. The clarification of its characteristics, classification and systematization of its diverse realizations is particularly important for contemporary law studies and legal implementation. Both Bulgarian and Austrian legislation are intrinsically continental legal systems which assumes a range of similarities between them, particularly concerning the interpretation and implementation of good faith principle. Selected realizations of this principle are reviewed as embedded in specific paragraphs of the Austrian Civil Code (ABGB) as well as articles of the Bulgaria Law on Obligations and Contracts that treat the principle in Bulgarian legislation.
